Data Validation / (drop down) compatibility

I have an Excel 2007 spreadsheet with a data validation (drop down) feature. When I get the file back from a colleague who uses 2010 the drop downs are not working and are actually gone A quick search found there is a bug in Excel 2007/2003 and the drop downs are no longer there. I looked on the forum and didn't find anything. Is is there a service pack (SP3 from what I read) that fixes this?

Excel Facts

Show numbers in thousands?
Use a custom number format of #,##0,K. Each comma after the final 0 will divide the displayed number by another thousand
