Formula to calculate break length in a timesheet

Hi, I am using Excel for scheduling my stuff and need a special rule which I can't set properly. I believe it will be possible to set it on Excel as it is just a calculation, but don't know how to do it. I have a list with all shifts of an employee for the week and need to check if he had 36 break ( time frame where he has no scheduled hours). I have the starting and the end times of each shift. Any help and advice here is more than welcomed, thanks. Here is an example of the schedule for one day

( time frame where he has no scheduled hours).

how is a break going to be shown - If he/she starts at 08:00 and finishes at 16:00 as per row 1 above
how do we know if taken a break ?
Why 36?

The 36 hours break is required by law. The employees must have at least one 36 hour interval between their various shifts in period of 7 days. The above example is a typical schedule for one employee. I have the dates and the starting and ending times for each shift. So I need the formula to calculate if this employee had his 36 hours break for the period 20.01-26.01. I want to run this formula when the weekly schedule is ready so if anyone missing his 36 h break I can make the proper adjustments before give the schedule to the employees. Hope it is more clear now, thanks.
