Range.FillDown Acting Weird??

I use the following code:
Range(Cells(3, 26), Cells(lr, 26)).FillDown

Which works fine UNLESS lr=3 then for somereason it fills from 1,26 to 3,26 which is def not what I want....

Sometimes the sheet doesnt have any data.. so it doesnt need to fill down, so is there a better way to fill down or should I just add in a check on 4,26 for null if so dont fill?
