Checking for data labels on a chart

I'm using a combobox to switch between different charts, unfortunately some of the charts have data labels and others don't. I can delete data labels with the following code. Can anyone help with the code to verify that data labels exist? If data labels do not exist, my code is falling down as it is trying to select an object that is not there.

ActiveChart.SeriesCollection(1).DataLabels.Select
selection.delete

If ActiveChart.SeriesCollection(1).HasDataLabels Then
   ActiveChart.SeriesCollection(1).DataLabels.Delete
End If
