Problem Creating Custom Cell Validation Formula

I am trying to create a custom formula for cell validation, but I'm not getting the results I am looking for with this:
Code:
instr(D4,",") =0 or len(d4) < 3

Cell must be more than 3 characters and contain a comma.

It doesn't matter what I enter now, it errors. eg: Doe, John results in an error.

Instr is a vba function, not an xl one. Try
Excel Formula:
=AND(ISNUMBER(FIND(",",D4)),LEN(D4)>3)
