conditional formatting ..issue

Hello

my range for my conditional format is

=$C$17:$K$24

however C18:K18 is wrapped around a yellow highlight

my formula for that range currently is
=$F17=MAX($F$17:$F$24)

so it highlights based on the largest % in column F

.......which is great

but where im having trouble is....i want to have the range C18:K18 in yellow, so i dont want conditional formatting applied for that range

HOWEVER:
i want to have F17:K17,C19:K24 show a red fill if the value in column ($F$17,$F$19:$F$24) is greater than 4%

can someone pls help! thx u so much
