Advanced Filter

I am trying to filter a list of times represented by text values such as 9:00am. When I try to filter the list for unique values the filter always returns two instances of the first value in the list if it is the same as the next value. The rest of the list filters as expected. I have tested it with straight numeric values such as 1,1,2,5,5,3,3( without the commas) and it returns a duplicate of the first numeric value each time. Does anyone know how to stop excel 2010 from returning duplicates of that first value when the list begins with 2 of more identical values?

That will happen when a distinct header is not available or the header is not selected while running the advanced filter.
