Conditional Formating Problem

I want to c/f cell AK if <>0,

I have entered this formula in the formula is function:

=VARP(AI9,AJ9)<>0

This produces a True argument but the cell will not format to my desired likings?

If I enter in Cell Value is =0 it will not format

There are no decimals evident

Does anyone know what might be the problem with the cell?

Any help would be great!

Is the cell part of a group of cells that have been merged?
If so, Excel has a problem with conditional formatting merged cells.

No it's just weird? I check to see if the cell had been merged but it just has 0 in it?

I'm totally confused
