Setting up filtering in code, problems with _FilterDatabase

Hello all,

I have a worksheet that needs to have autofiltering added to it. The problem is that I do not control the format and there are misc data rows underneath the totals row and Excel picks these up in the _FilterDatabase named range. This value can be seen by clicking the Advanced icon next to the Filter icon in the Data tab. It lets me edit it, but then resets it anyway.

Because the misc data gets picked up in the filter range, my subtotals, which are above the misc data, get swallowed up and don't display whenever I filter. Is there a way to stop Excel from resetting the _FilterDatabase named range RefersTo value after I set it?
