Conditional Formatting rule disappear when closing

I have 2 problems I can't really get working.
First is I want this formula to be used on all spreadsheets.
Second problem is when I enter it into conditional formatting, save and close. It disappears.

Anyone had the same problem, or is there a rule i'm forgeting?
 

Excel Facts

Enter current date or time
Ctrl+: enters current time. Ctrl+; enters current date. Use Ctrl+: Ctrl+; Enter for current date & time.
Solved problem number 2 if someone stumbles upon this post.
I had to save it with a newer version of excel. It was saved with the 97-2003 version.

For problem number 1 I had to apply the rule for every sheet. I did not find a solution on that one.
